Terms of Service

1. These terms

These Terms of Service (“Terms”) cover your use of the Finalshot website, the Finalvision console, public tournament pages, and Finalshot Media services (together, the “Service”), run by Finalshot in Puerto Rico (“we”, “us”). By using the Service you agree to these Terms and to our Privacy Policy. If you use the Service for a school, club or team, you confirm you are allowed to accept these Terms for it.

2. Accounts

The console has no open sign-up: a Finalshot administrator or a school manager must add your email address first. Accounts are for adults acting for a program. Keep your password private; you are responsible for activity under your account, and you should tell us right away if you think someone else has used it.

We, or the program that added you, can remove your access at any time. Removing access deletes the account.

3. Acceptable use

You agree not to:

• Access accounts, teams, tournaments or data that are not yours, or try to get around any access control.
• Share a scorer code with anyone it was not given to, or enter results you know are false.
• Upload video, photos or information you do not have the right to share.
• Send anything unlawful, abusive, misleading or spam through any form on the Service.
• Interfere with the Service, scrape it at scale, or copy it to build a competing product.

4. Your program's data

Programs own the rosters, schedules, results, video and other information they put into the console (“Program Data”). You give us permission to store, process and display Program Data to run the Service for your program, including producing clips, measurements and match analysis, and to use it in de-identified, aggregate form to improve Finalvision.

You are responsible for having the right to share Program Data with us, including information about athletes who are minors, and for following any school, league or parental permission rules that apply to your program.

5. Tournaments

When a tournament is announced, its bracket, the names of the schools and teams entered, match times, courts and results are published on a public page. Hosts and Finalshot set up the draw; results are entered by Finalshot, the host, or people holding a scorer code. We work to keep brackets accurate, but the host's and officials' records decide official results, and we may correct a result at any time.

A scorer code lets its holder enter results for one tournament only. It is personal to the person we gave it to, and we can revoke it at any time.

6. Finalshot Media

Photography and video are booked directly with us. Prices on this site are starting points; the scope, price and delivery time for each booking are agreed with you in writing (including by message) before the shoot. If weather, a schedule change or a cancelled match affects a shoot, we will work with you to reschedule.

We keep the copyright in the photos and video we create. Clients may use delivered work for their team, school and personal purposes, including social media with credit to Finalshot where practical. Commercial use, such as advertising or resale, needs our written agreement. We may use our work, including photos from tournaments and events, on our website and social media to show what we do. If you want a photo of yourself or your child taken down, contact us and we will remove it from our website and accounts.

7. Our property

The Service, including its software and design and the Finalshot and Finalvision names and marks, belongs to us. These Terms give you only the right to use the Service as intended. Program Data stays yours, as described above.

8. Changes to the Service

Finalvision is an early-stage product. Features marked as beta or in development may change, and we may add, change or remove features. We will try to give notice of changes that significantly affect existing accounts.

9. Measurements are estimates

Clips, measurements, tracking and analysis are produced automatically from video and are estimates. They can be incomplete or wrong. They are not medical, safety, injury or training advice, and should not be the only basis for decisions about playing time, recruiting, health or safety.

10. Disclaimer

The Service is provided “as is” and “as available”. To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement, and we do not promise that the Service will be uninterrupted or error-free.

11. Limitation of liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim, or one hundred U.S. dollars (US$100). Nothing in these Terms limits liability that cannot be limited by law.

12. Ending use

You can stop using the Service at any time. We may suspend or end access to the Service if these Terms are broken or to protect the Service or other users. Sections that by their nature should continue after access ends (including sections 4, 6, 7, 9, 10, 11 and 13) continue to apply.

13. Governing law

These Terms are governed by the laws of the Commonwealth of Puerto Rico and applicable U.S. federal law. Any dispute will be brought in the courts located in Puerto Rico, and you and we agree to their jurisdiction. Before filing a claim, please contact us so we can try to resolve it informally.

14. Changes to these Terms

We may update these Terms as the Service changes. We will change the date at the top, and for significant changes we will tell account holders. Continuing to use the Service after a change means you accept the updated Terms.
